Can you serve notices and documents for me?
Yes. Serving notices and legal documents is a core part of what we do. We serve documents in the manner Oregon law requires and provide proper proof of service for your records and the court.
Do I have to appear in court myself?
In many cases, no. We can arrange representation for the First Appearance and handle the court filings and appearances as part of our services. Whether you need to appear depends on the specifics of your case, which we'll go over with you.
The Eviction Process in Oregon
How does the eviction process work in Oregon?
At a high level: the landlord serves the tenant a proper written notice; if the tenant doesn't comply, the landlord files an eviction (FED) case in the county circuit court; the tenant is served with the court summons; there is a First Appearance hearing; if the case isn't resolved there, it may proceed to trial; and if the landlord prevails, the court issues a judgment and the county sheriff can carry out a lockout. The exact steps and timing depend on your county and the details of your case.
What's the difference between a for-cause and no-cause eviction?
Generally, a for-cause termination is based on a specific reason, such as nonpayment of rent or a lease violation, while a no-cause termination ends a tenancy without stating a reason. Oregon law limits when and how no-cause terminations may be used, so which applies to your situation depends on your circumstances. How long does an eviction take?
It varies. Timelines depend on the type and reason for the notice, the county court's schedule, whether the tenant contests the case, and other factors. During your consultation we can give you a realistic estimate for your specific situation.
What happens if the tenant doesn't leave after the notice?
If a tenant doesn't comply with a valid notice, the usual next step is filing an eviction case in the circuit court. If the court rules in the landlord's favor and the tenant still doesn't leave, the county sheriff carries out the lockout. We can assist with each of these steps.
